After the livestock belonging to this estate had been sold under order of court, and a portion of the proceeds applied to payment of a mortgage-indebtedness, Eugene C. Potter, the administrator of the estate, who was also a son and heir at law of the deceased, petitioned for sale, at not less than its appraised value, of all the estates real, and the balance of the personal, property. The administrators petition represented that those properties might depreciate in value unless sold; their sale would be of advantage to the beneficiaries of the estate; there were unpaid mortgage-balances of $48,150 on the ranch real property, and $48,356.96 on the town real property; and an unliquidated claim of the Department of Internal Revenue in the sum of $80,000, as well as the cost and expenses of administration yet to be paid.
